You retain copyrights to any content you create for your member site, including all text and images. TrueProSites has the right to display your content on your TrueProSite, may link to your TrueProSite, and may use screenshots or synopsis in promotional materials. TrueProSites does retain copyrights to all design, methods, and systems used to display all TrueProSite sites, including but not limited to, layout, color schemes, navigation, architecture, html, css, javascript, backend systems, and databases.
Any unlawful, harmful, threatening, abusive, harassing, defamatory, vulgar, obscene, sexually explicit, libelous, invasive of another's privacy, hateful, or racially, ethnically or otherwise objectionable content is prohibited on TrueProSites.
Do not post work from others as your own. You can quote small samples from other sources if you cite the source. Do not infringe on other parties trademarks, trade secrets, patents, or other legal rights. Do not intentionally or unintentionally violate any applicable local, state, national, or international law, including, but not limited to, regulations promulgated be the U.S. Securities and Exchange Commission, any rules of any national or other securities exchange, including, the New York Stock Exchange (NYSE), the American Stock Exchange (AMEX), and the National Association of Securities Dealers Automated Quotations system (NASDAQ), the Chicago Board of Trade (CBOT), and any regulations having the force of law.
TrueProSites retains the right to suspend or cancel any account at any time.
Paypal Subscriptions may be cancelled at any time by the member on the Paypal website.
You agree not to reproduce, duplicate, copy, sell, resell or exploit for any commercial purposes, any portion of the Service, use of the Service, or access to the Service.
Advertisements and affiliate links for 3rd party sites are not permitted on free member accounts, and may be limited on paid accounts. TrueProSites retains the right to run advertisements or affiliate links on all member accounts. In addition, TrueProSites may have affiliate agreements with some sites to which links are provided as a convenience to members, such as to member works on Amazon.com
BrillaintLime retains the right to display one or more links to itself or a subsidiary site on all member sites.
Members are strictly prohibited from emailing spam from their member account.
Members are forbidden to engage in any practice designed to deceive search engines into increase their page rankings or into including their pages for content that does not exist.
NOT UNDER ANY CIRCUMSTANCES SHALL TrueProSites BE LIABLE TO YOU OR ANY THIRD PARTY FOR ANY INDIRECT, CONSEQUENTIAL, EXEMPLARY, INCIDENTAL, SPECIAL OR PUNITIVE DAMAGES. THIS INCLUDING LOST PROFIT, LOST GOODWILL, LOST USE, LOST DATA OR OTHER INTANGIBLE LOSSES OR DAMAGES ARISING FROM ANY USE OF THIS SERVICE (EVEN IF TrueProSites HAS BEEN ADVISED OF THE POSSIBILITY OF SUCH DAMAGES) RESULTING FROM (i) THE USE OR THE INABILITY TO USE THE SERVICE (ii) THE COST OF PROCUREMENT OF SUBSTITUTE GOODS AND SERVICES RESULTING FROM ANY GOODS, DATA, INFORMATION OR SERVICES PURCHASED OR OBTAINED OR MESSAGES RECEIVED OR TRANSACTIONS ENTERED INTO THROUGH OR FROM THE SERVICE (iii) UNAUTHORIZED ACCESS TO OR ALTERATION OF YOUR TRANSMISSIONS OR DATA (iv) STATEMENTS OR CONDUCT OF ANY THIRD PARTY ON THE SERVICE (v) ANY OTHER MATTER RELATING TO THE SERVICE.
TrueProSites MAKES NO WARRANTY THAT (i) THE SERVICE WILL MEET YOUR REQUIREMENTS, (ii) THE SERVICE WILL BE UNINTERRUPTED, TIMELY, SECURE, OR ERROR-FREE, (iii) THE RESULTS THAT MAY BE OBTAINED FROM THE USE OF THE SERVICE WILL BE ACCURATE OR RELIABLE, (iv) THE QUALITY OF ANY PRODUCTS, SERVICES, INFORMATION, OR OTHER MATERIAL PURCHASED OR OBTAINED BY YOU THROUGH THE SERVICE WILL MEET YOUR EXPECTATIONS, AND (V) ANY ERRORS IN THE SOFTWARE WILL BE CORRECTED.
NO ADVICE OR INFORMATION, WHETHER ORAL OR WRITTEN, OBTAINED BY YOU FROM TrueProSites OR THROUGH OR FROM THE SERVICE SHALL CREATE ANY WARRANTY NOT EXPRESSLY STATED IN THESE TERMS AND CONDITIONS.
You specifically hereby waive any claim for damages of any kind whether direct, indirect, special, exemplary, punitive, incidental or consequential, loss of profits or loss of business as the result of any action taken in response to any claim of copyright infringement without regard to whether or not the material claimed to have been infringing is later found to be infringing.
You agree to indemnify and hold www.TrueProSites, its subsidiaries, and affiliates, and their respective officers, agents, partners and employees, harmless from any loss, liability, claim, or demand, including reasonable attorneys' fees, made by any third party due to or arising out of your use of the Services in violation of this Agreement and/or arising from a breach of this Agreement and/or any breach of your representations and warranties set forth above and/or if any Content that you post on the Website or through the Services causes TrueProSites to be liable to another.
You agree to fully defend and indemnify and hold harmless TrueProSites of and from any and all third party claims, causes of action, demands, costs, damages including both direct and consequential damages, specifically including attorneys fees and costs, expert fees and costs and mediation and/or arbitration fees and costs incurred (whether paid or not) as the result of any violation or claimed violation of any copyright or other intellectual property right of any third party which is in any way related to your use of the TrueProSites service or any portion thereof. Choice of counsel remains exclusively that of TrueProSites.
You agree that upon the assignment of your account ID and password that you will maintain the confidentiality of your account information and are fully responsible for all activities that occur under your password or account. You and assume all responsibility of and from any loss, theft or other destruction of any data as the result of any access to your account via the use of your account ID. You further agree to defend and indemnify and hold harmless TrueProSites of and from any and all third party claims, causes of action, demands, costs, damages including both direct and consequential damages, specifically including attorneys fees and costs, expert fees and costs and mediation and/or arbitration fees and costs incurred (whether paid or not) as the result of any claim for damages in any way related to the disclosure of your confidential Account ID and Password information. Choice of counsel remains exclusively that of TrueProSites.
This Agreement shall be interpreted under the laws of the State of California without regard to any conflict of laws provisions. Any action between the parties to this agreement for the breach of this agreement or any action or claim in any way relating thereto shall be venued in the Superior Court of the State of California, County of San Diego. The parties this agreement hereby consent to jurisdiction in that court and agree to accept service by mail and hereby waive any defense of any kind related to jurisdiction or venue.
